TERMS OF SERVICE

1. DEFINITIONS
1.a

"We", "us" and "our" refer to the operator of the Flit service. "You" and "your" refer to any person who accesses or uses the Service.

1.b

"Service" means the Flit website, the Flit mobile applications, and all related interfaces and features made available by us.

1.c

"Flit" means an individual item of Content submitted to the Service for expiring distribution, together with the expiry rules applied to it. "To flit" means to submit Content to the Service.

1.d

"Content" means any file, media item, link, or message you submit to the Service.

1.e

"Share Link" means the URL generated for a Flit, including the portion following the #character. "Key" means the cryptographic key used to encrypt and decrypt a Flit; for end-to-end encrypted Flits the Key forms part of the Share Link.

2. ACCEPTANCE OF TERMS
2.a

By accessing or using the Service you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

2.b

We may amend these Terms at any time. An amendment takes effect when published on this page, and your continued use of the Service after publication constitutes acceptance of the amended Terms.

2.c

The "Last updated" date shown at the head of this page indicates when these Terms were last amended.

3. DESCRIPTION OF THE SERVICE
3.a

The Service enables you to create expiring Share Links for files, media, links, and messages. Each Flit expires automatically in accordance with the rules you select: by elapsed time, by number of views, or by both.

3.b

No account is required to create or view a Flit. Account registration is optional and is governed by Section 9.

3.c

The Service is provided on an as-is and as-available basis. We make no representation or warranty as to uptime, availability, or uninterrupted operation. See Section 11.

3.d

Flits created in the Flit web application and the Flit iOS application are end-to-end encrypted. Content is encrypted on your device, and the Key travels only within the Share Link and is never transmitted to us. We are technically incapable of reading your Flits, and we cannot recover a Flit for you if its Share Link is lost.

3.e

We hold a one-way fingerprint of each Key. It is used solely to distinguish a genuine Share Link from an incomplete or fabricated one before a view is consumed. A fingerprint cannot be reversed and cannot decrypt Content. The Privacy Policy sets out what this does and does not protect.

5. LIMITATIONS OF EXPIRY CONTROLS
5.a

We enforce the expiry rules you select on our servers. Once a Flit expires or reaches its view limit, the Content is deleted and the Share Link ceases to function. Opening an incomplete or invalid Share Link does not consume a view, so a Share Link damaged in transit does not consume the Flit.

5.b

The expiry controls operate on the Service only. We can neither prevent nor detect:

  • (i)screenshots or screen recordings taken while a Flit is open;
  • (ii)downloads or copies saved by the recipient before expiry; or
  • (iii)the original Share Link being forwarded to another person while it remains active.
5.c

We apply measures within our control to discourage copying, including restricting right-click and download controls for images and video in the Flit viewer. These measures reduce casual copying but cannot prevent determined circumvention.

5.d

The Service is designed to limit unintended distribution and does not guarantee it. You should not flit Content where the consequences of it being copied or redistributed would be unacceptable to you.

6. ACCEPTABLE USE
6.a

You must not use the Service to flit Content that:

  • (i)is illegal in your jurisdiction or in the jurisdiction of the recipient;
  • (ii)constitutes child sexual abuse material (CSAM). Such Content will be reported to the relevant authorities;
  • (iii)constitutes harassment, threats, or targeted abuse;
  • (iv)is designed to deceive, phish, or defraud;
  • (v)distributes malware, ransomware, or other malicious code;
  • (vi)infringes the intellectual property rights of another person; or
  • (vii)constitutes spam or unsolicited bulk messaging.
6.b

You must not attempt to circumvent the expiry, quota, or access controls of the Service, nor attempt to access a Flit for which you have not been given a Share Link.

6.c

A breach of this Section entitles us to act under Section 7 without prior notice.

7. CONTENT REMOVAL AND MODERATION
7.a

We reserve the right to remove any Flit and to suspend or terminate any account that violates these Terms, without prior notice.

7.b

You may report Content you believe violates these Terms using the report function available on every Flit page.

7.c

Because Flits are end-to-end encrypted, we do not and cannot monitor, scan, or proactively review their Content. Review occurs only where a person holding the Share Link submits a report; submitting a report includes the Key from the Share Link that person already holds, so that moderators can see what is being reported.

7.d

We may delete a Flit or disable a Share Link at any time without reading its Content.

8. YOUR CONTENT
8.a

You retain ownership of the Content you flit.

8.b

By submitting Content you grant us a limited, non-exclusive, royalty-free licence to store, reproduce, and transmit that Content solely for the purpose of operating the Service.

8.c

For end-to-end encrypted Flits, the material stored and transmitted under the licence granted in Section 8.b is the encrypted form of the Content.

8.d

The licence granted in Section 8.b terminates when the Flit expires or is revoked.

9. ACCOUNTS
9.a

Registration is optional; the Service may be used anonymously.

9.b

You are responsible for maintaining the confidentiality and security of your credentials and for all activity carried out under your account.

9.c

You may delete your account at any time. Deletion removes your account data and revokes all active Flits associated with it.

10. SUBSCRIPTIONS AND BILLING
10.a

The Service offers a free tier and a paid tier (“Premium”). Premium raises usage limits; it does not change how Content is encrypted, stored, or expired. End-to-end encryption is provided on all tiers, including the free tier.

10.b

Premium bought on this website is sold by Polar Software, Inc. as merchant of record. Polar is the seller for those purchases, is responsible for collecting and remitting any applicable sales tax or VAT, and its buyer terms apply to them in addition to these Terms. Premium bought in the iOS app is sold by Apple, and Apple's terms govern payment, billing and refunds for it.

10.c

Subscriptions renew automatically for successive periods at the then-current price until cancelled. You may cancel at any time; cancellation stops future renewals and does not shorten the period you have already paid for.

10.d

Cancellation is made through the provider you purchased from: through your Apple ID subscription settings for App Store purchases, or through the billing portal linked from your account for web purchases. We cannot cancel or refund a purchase made through the App Store.

10.e

App Store purchases are refunded by Apple through its own process. Cancelling is not a refund: it stops future renewals and leaves access running to the end of the period already paid for. Full detail is in the Refund Policy.

10.f

Where you have a statutory right to cancel or to a refund, that right is unaffected by this section. Contact support@getflit.app and we will pass the request on to the provider you purchased from.

10.g

A free trial, where offered, converts to a paid subscription at the end of the trial period unless cancelled before it ends. Promotional codes and free trials may not be combined, and a code may make you ineligible for a trial.

10.h

Prices may change. A change to the price of a renewing subscription takes effect at the next renewal, and we will give notice before it applies.

10.i

Premium is tied to your Flit account, not to a device or an app store account. An account may hold only one active subscription at a time; we may decline a purchase made through one provider while a subscription from another provider is active on the same account.

10.j

Failure to pay, a reversed payment, or expiry of a subscription returns the account to the free tier. Content already flitted is unaffected and continues to expire under the rules applied when it was created.

11. DISCLAIMER AND LIMITATION OF LIABILITY
11.a

The Service is provided "as is" and "as available" without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

11.b

We are not liable for any Content flitted by users.

11.c

To the fullest extent permitted by law, we are not liable for any indirect, consequential, incidental, special, or punitive loss or damage arising from your use of, or inability to use, the Service, including loss of data, loss of revenue, or loss of business opportunity, even if we have been advised of the possibility of such loss.

11.d

Our aggregate liability for any direct claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11.e

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

12. INDEMNIFICATION
12.a

You agree to defend, indemnify, and hold harmless Flit and its operators from and against any claim, damage, loss, liability, or expense (including reasonable legal fees) arising out of or relating to:

  • (i)your use of the Service;
  • (ii)the Content you flit; or
  • (iii)your breach of these Terms.
12.b

This Section applies whether the Flit was created with or without an account.

14. FORCE MAJEURE
14.a

We are not liable for any failure or delay in providing the Service caused by events beyond our reasonable control, including outages of third-party infrastructure providers, internet or network failures, natural disasters, or acts of government.

14.b

In such events we will make reasonable efforts to restore the Service as promptly as practicable.

15. GOVERNING LAW AND JURISDICTION
15.a

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws provisions.

15.b

Any dispute arising out of or relating to these Terms or your use of the Service shall be resolved exclusively in the competent courts of the Philippines.

16. GENERAL
16.a

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

16.b

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of any other.

16.c

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us in relation to the Service.
